Jamia Nizamia Hyderabad released a historic fatwa pertaining to the Riba in a non-Muslim state. It says:
According to Imam Abu Hanifa, any dealing between a Muslim and a non-Muslim in Darul Harb which involves addition or reduction of the capital amount is not regarded Riba, therefore the ruling of illegitimacy, as mentioned in Hadaya Vol. 3, Baburriba page 192 :
“Laa Riba bain al Muslim wal harbi fee darul harb“,
does not apply on such dealing.
The rules of the “contract and selling” will not apply but the consent of the owner is compulsory. The dealing can be acquired from the natives of the Darul Harb if there is no cheating or fraud.
In Darul Islam (Muslim state), the Shariah rules of “contract and selling” as well as the consent of the owner, both are compulsory for any dealing to be legitimate. It is not legitimate if both parties give their consent, and the nature of the dealing is not according to Shariah rules. Contrary to this, in a Darul Harb (non-Muslim state), the consent of the owner is enough as if the Muslim does not have dictating power on the nature of the contract.

Every addition of money which is acquired by the “contract” is called Riba. Since in a non-Muslim state, the Shariah conditions of the contract are not applicable, therefore, the definition of the Riba too is not applicable there.
The Fuqha go to the extent to say that in a territory which has come under the control of non-Muslims but has not been declared non-Muslim yet, and still considered as a Muslim state, and a Muslim migrates legally there and enters into any deal (which is not valid in a Muslim state) which involves usury, then this kind of dealing will not be regarded as usury, it is legitimate.
